Although no company has yet been taken to court in the UK for being in breach of part III of the Disability Discrimination Act 1995 (DDA) regarding website accessibility, the RNIB has actively approached companies and asked them to comply with the World Wide Web Consortium's* guidelines on accessibility rather than face legal action and public exposure.

No test case has yet indicated how a court would define 'reasonable steps' - the actions a business needs to take to make a service accessible for those with disabilities - though the law is expected to use the World Wide Web Consortium (W3C) guidelines as a benchmark. It's anticipated that the 'reasonable' level of compliance demanded would also depend on the type of service in question.

The W3C guidelines fall under three priorities: priority 1, you MUST comply; priority 2, you SHOULD comply; and priority 3, you MAY comply. However, the EU has recommended to member states that they take priority 1 and 2 guidelines as the benchmark in legal cases.

What's our approach to accessibility?

At miggle, we believe following W3C guidelines helps us design functional and user-friendly sites for our clients and their audiences.

All pages on miggle.co.uk comply with priority 1 and priority 2 guidelines of the W3C Web Content Accessibility Guidelines and the U.S. Federal Government Section 508 Guidelines. We see priority 3 guidelines as best practice.
